JUDGMENT


On August 29, 2003, the United States Magistrate Judge's Recommendation was filed and notice was served on the parties pursuant to 28 U.S.C. § 636(b). The Recommendation was withdrawn on September 26, 2003, and it was reinstated on May 3, 2004. No objections were received by the court within the time prescribed by the statue.

The court hereby adopts the Magistrate Judge's Recommendation.

IT IS THEREFORE ORDERED AND ADJUDGED that Defendant's motion for summary judgment [Pleading no. 31] be GRANTED and that the case be DISMISSED.
