Jacobson Cannot Establish a Prima Facie Case of Disability Discrimination To establish her prima facie failure to accommodate claim, Jacobson must prove that: (1) she was disabled; (2) Capital One had notice of her disability; (3) Jacobson could perform the essential functions of her job with reasonable accommodation; and (4) Capital One refused to make such accommodations. Clark v. Jewish Childcare Ass'n, Inc., 96 F. Supp. 3d 237, 250 (S.D.N.Y. 2015) (citing McMillan, 711 F.3d at 125). To establish her prima facie disability discrimination claim, Jacobson must prove that: (1) she was disabled; (2) she was otherwise qualified to perform the essential functions of her job with or without reasonable accommodation; and (3) she suffered an adverse employment action because of her disability.
