DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Rockland County, dated February 9, 2021. Motion by the respondent to dismiss the appeal from so much of the order as pertains to Family Court Docket No. F-01659-2017/2020D, with costs, on the ground that this portion of the appeal has been rendered academic, and to extend the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal from so much of the order as pertains to Family Court Docket No. F-01659-2017/2020D, with costs, is granted to the extent that the appeal from so much of the order as pertains to Family Court Docket No. F-01659-2017/2020D is dismissed, without costs or disbursements, the appellant's brief is stricken, on or before December 1, 2021, the appellant shall serve a replacement appellant's brief and upload a digital copy of the replacement brief, with proof of service thereof, through the digital portal on this Court's website, which raises issues only as to Family Court Docket No. F-01409/2020 and not as to Family Court Docket No. F-01659-2017/2020D, and this branch of the motion is otherwise denied; and it is further, ORDERED that the branch of the motion which is to extend the respondent's time to serve and file a brief is granted, and on or before January 3, 2022, the respondent shall serve the respondent's brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
