DECISION & ORDER ON MOTION
Motion by respondent for leave to renew and reargue appellant's prior motion for a stay pending the determination of an appeal from an order of the District Court of Nassau County, First District, entered January 21, 2016, which was determined by decision and order on motion of this court dated January 28, 2016.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion for leave to renew and reargue is granted and, upon renewal and reargument, the original determination is adhered to on condition that appellant perfect the appeal by July 1, 2016; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
In view of respondent's showing of hardship, the court will consider the appeal on an expedited basis.
