It appearing to the Court that the Fifth District Court of Appeal did not declare invalid a state statute or a provision of the State Constitution, and that, therefore, this Court is without jurisdiction, this appeal is hereby dismissed subject to reinstatement if jurisdiction is established on proper motion filed within fifteen (15) days from the date of this order. See Art. V, § 3(b)( 1), Fla. Const.
