ORDERED that the motion for lower court to stipulate to the record is denied, without costs, and without prejudice to an application by petitioner, in the court of original instance, to settle the record as required by section 850.7 (b) of this Court's Rules of Practice, and it is further
ORDERED that the motion for an extension of time to perfect the proceeding is denied, without costs, and without prejudice to renewal in the event petitioner moves for and obtains vacatur of the dismissal of the proceeding (see 22 NYCRR 1250.10 [c]).
