ORDER DIRECTING PLAINTIFF TO FILE NEW IN FORMA PAUPERIS APPLICATION - LONG FORM [ECF NO. 1]
Plaintiff Terria McKnight has filed a request to proceed in forma pauperis (“IFP”) (ECF No. 1). Upon review of the documents filed herein, the Court finds that Plaintiff's declaration is insufficient for the Court to act on the application. Thus, the Court denies the IFP application. Plaintiff shall either: (1) file the attached fully complete long form application to proceed IFP with the Clerk of Court; or (2) pay the full filing fee of $402 (consisting of the $350 filing fee and $52 administrative fee).
Additionally, the Court notes Plaintiff's complaint, (ECF No. 1-1), in unsigned. However, “[e]very pleading, written motion, and other paper must be signed by at least one attorney of record in the attorney's name-or by a party personally if the party is unrepresented.” Fed.R.Civ.P. 11(a). Accordingly, Plaintiff must submit to the Court a signed complaint for the Court's consideration.
Accordingly, IT IS ORDERED that Plaintiff's IFP application, (ECF No. 1), is DENIED.
IT IS FURTHER ORDERED that Plaintiff shall complete the attached “Application to Proceed in District Court Without Prepaying Fees or Costs - Long Form”.
IT IS FURTHER ORDERED that on or before Thursday, December 29, 2022, Plaintiff shall either: (1) file the attached fully complete application to proceed IFP with the Clerk of Court; or (2) pay the full filing fee of $402 (consisting of the $350 filing fee and $52 administrative fee).
IT IS FURTHER ORDERED that Plaintiff must submit a signed complaint to the Court by Thursday, December 29, 2022.
IT IS FURTHER ORDERED that, if Plaintiff fails to timely file a completed IFP application or pay the filing fee, and fails to timely submit a signed complaint, the Court will recommend dismissal of this action without prejudice.
IT IS SO ORDERED.
