GARY E. MCKINLEY, Petitioner, v. THE HONORABLE RICHARD WAGNER, DISTRICT JUDGE; AND THE SIXTH JUDICIAL DISTRICT COURT OF THE STATE OF NEVADA, IN AND FOR THE COUNTY OF PERSHING, Respondents.
An unpublished order shall not be regarded as precedent and shall not be cited as legal authority. SCR 123.
ORDER DENYING PETITION FOR WRIT OF CERTIORARI
This original proper person petition for a writ of certiorari challenges a district court order granting a motion to stay discovery pending resolution of a writ petition that petitioner previously filed in that court.
Having considered the petition and the attached exhibits, we decline to exercise our discretion to intervene in this matter by way of extraordinary writ relief. See NRS 34.020 (explaining that a writ of certiorari is available when the district court has exceeded its jurisdiction and no plain, speedy, and adequate remedy exists to remedy the district court's action); Zamarripa v. First Judicial Dist. Court, 103 Nev. 638, 640, 747 P.2d 1386, 1387 (1987) (recognizing that the decision to consider a petition for a writ of certiorari is discretionary with this court). Accordingly, we deny the petition. See NRAP 21(b)(1) and (c); Zamarripa, 103 Nev. at 640, 747 P.2d at 1387.
It is so ORDERED.
