This case was tried with the case of Winthrop v. The Manhattan Railway Company, decided herewith ( ante, p. 509), and presents precisely the same questions For the reasons stated in Winthrop v. The Manhattan Railway Company the judgment appealed from is affirmed, with costs. O'Brien, Rumsey, Williams and Parker, JJ., concurred.
