ORDER TO SHOW CAUSE

This case was called from the calendar of the Court's New York City, New York, May 15, 2023, trial session. There was no appearance by or on behalf of the petitioner. Respondent appeared and was heard.

On May 12, 2023, respondent filed with the Court a Motion to Dismiss for Failure to Properly Prosecute. On May 15, 2023, respondent stated that a basis of settlement was reached, and decision documents were mailed to petitioner. Petitioner did not sign the documents and remains unresponsive.

Upon due consideration and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that respondent's May 12, 2023, Motion to Dismiss for Failure to Properly Prosecute is taken under advisement. It is further

ORDERED that this case is continued, and jurisdiction is retained by the undersigned. It is further

ORDERED that on or before June 14, 2023, petitioner shall show cause in writing as to why respondent's Motion to Dismiss for Failure to Properly Prosecute should not be granted, and a decision entered for the amount and for the year set forth in respondent's motion.
