Donald Ray MCINTOSH, Appellant v. The STATE of Texas, Appellee

From the 379th Judicial District Court, Bexar County, Texas Trial Court No. 2024CR0128 Honorable Ron Rangel, Judge Presiding

ORDER

Lori I. Valenzuela, Justice.

Appellant's brief was originally due to be filed on July 31, 2024. Appellant's first motion for extension of time was granted, extending the deadline for filing the brief to August 30, 2024. On September 3, 2024, appellant filed a second motion for extension of time, which we granted, extending the deadline for filing the brief to September 30, 2024. The order stated, "Further requests for extension of time will be disfavored."

On October 2, 2024, appellant filed a third motion for extension of time requesting an additional thirty days to file the brief. In the interest of justice, the motion is GRANTED. Appellant's brief must be filed no later than October 30, 2024. This is the final extension of time appellant will be granted absent extenuating circumstances. See TEX. R APP. P. 38.8(b)(4) (appellate court must "act appropriately to ensure that the appellant's rights are protected" when the appellant's brief is not timely filed).
