On Application for Rehearing filed on February 13, 2012, by Thomas L. McGuire, III and E. Douglas Henriksen: Rehearing Application is DENIED.
The issue of whether or not the plaintiffs have sustained any special damages is inextricably interwoven with the issues of the validity of the mortgage and the ownership of the Florida property. Ownership, equitable liens effects and special damages arising from those matters are matters subject to the jurisdiction of Florida courts and, hence, they should be addressed there. Further, plaintiffs are not entitled to attorney's fees under La. C.C. art. 1958, since the present suit is one for damages rather than recision.
