ORDER TO SHOW CAUSE

Eunkyong Choi Special Trial Judge

This case was calendared for trial at the Court's June 13, 2022, New York City, New York trial session. At that time respondent made an Oral Motion for Continuance explaining that petitioner had contacted them saying their son was in the hospital and were not able to appear. On August 12, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. The motion alleges that since June respondent has not heard from petitioner and has not received any additional information from petitioner to try and resolve this case. Respondent has been unable to establish contact with petitioner to resolve the case.

Upon due consideration, it is hereby

ORDERED that, on or before August 31, 2022, petitioner shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution filed August 12, 2022, should not be granted and a decision entered against petitioner for the amounts and year set forth in respondent's motion..

Petitioner is advised that the failure to respond to this order may result in the dismissal of this case and entry of decision as requested in respondent's motion.
