On March 6, 2024, respondent filed a Motion for Summary Judgment. Further, on April 8, 2024, petitioner filed a Motion for Continuance. This case was called from the calendar of the Court's New Orleans, Louisiana, trial session, on May 6, 2024. Petitioner and counsel for respondent appeared and were heard. During a subsequent recall, the Court identified that the caption of this case needed to be amended due to petitioner's last name being misspelled. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that the caption of this case is amended as follows: "Douglas D. McGinity, Petitioner v. Commissioner of Internal Revenue, Respondent." It is further

ORDERED that respondent's Motion for Summary Judgment, filed March 6, 2024, is taken under advisement. It is further

ORDERED that petitioner's Motion for Continuance, filed April 8, 2024, is denied. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
