McGeorge v. State

District Court of Appeal of Florida, First District
Feb 1, 1994
630 So. 2d 232 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-2414.

February 1, 1994.

Petition for Writ of Certiorari — Original Jurisdiction.

Nancy A. Daniels, Public Defender, Carl S. McGinnes, Asst. Public Defender, Tallahassee, for petitioner.

Robert A. Butterworth, Atty. Gen., James W. Rogers, Asst. Atty. Gen., Dept. of Legal Affairs, Tallahassee, for respondent.

There is no authority to support the trial court's "reimposition" of petitioner's sentence of one year of probation. We therefore grant the petition and quash the sentence imposed January 26, 1993.

SMITH and ALLEN, JJ., concur.
