On Appeal from the Criminal District Court No. 5 Dallas County, Texas
Trial Court Cause No. F16-00452-L
ORDER
Appellant filed his notice of appeal October 11, 2016. Three days later, appellant noted on his docketing statement that the court reporter had been waived. In light of this, appellant's brief was due March 10, 2017, thirty days after the clerk's record was filed.
On March 15, 2017, appellant filed a motion to extend time to file his brief, stating he needed additional time due to his work load. We granted the motion. When he did not file his brief by April 9, we notified him by email that the brief was past due. In response, appellant filed a letter stating that the reporter's record had not been filed. A subsequent April 26 letter from appellant noted he had contacted court reporter Debi Harris who would need at least thirty days in which to file the reporter's record. To date, the reporter's record has not been filed and we have had no communication from the court reporter or from appellant.
We ORDER court reporter Debi Harris to file the reporter's record in this appeal by June 12, 2017. We caution Ms. Harris that the failure to do so will result in the Court taking whatever remedies it has available, including ordering that she not sit until the complete reporter's record in this appeal is filed.
We DIRECT the Clerk to send copies of this order to Judge Carter Thompson, Presiding Judge, Criminal District Court No. 5; to Debi Harris, court reporter of the Auxiliary Court No. 8; to Victoria Franklin, official court reporter, Criminal District Court No. 5; and to counsel for all parties.
