MADISON MCDONALD, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 204th Judicial District Court Dallas County, Texas Trial Court Cause No. F21-33495

ORDER

NANCY KENNEDY, JUSTICE

On June 26, 2023, this Court direct the Clerk of this Court to temporarily seal volume 1 of the clerk's record filed June 23, 2023, because it contained documents purportedly under seal. We abated the appeal for the trial court to determine whether those documents should be sealed. On September 6, 2023, the trial court ordered that none of the documents in the clerk's record should be under seal following the trial, and the trial court ordered that "the documents are now not subject to seal." The trial court and this Court on September 11, 2023, ordered the district clerk to refile volume 1 of the clerk's record within ten days. The district clerk has not refiled the clerk's record. Because the clerk's record was not stricken, we VACATE our orders of June 26, 2023, and September 11, 2023. We DIRECT the Clerk to unseal the clerk's record filed June 23, 2023.

The record is complete. Appellant's brief is due NOVEMBER 13, 2023.

We DIRECT the Clerk to send copies of this order to Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
