Joseph A. McDonald, II, Petitioner v. Commissioner of Internal Revenue, Respondent

ORDER

Emin Toro Judge

This case is currently set for trial at the Court's September 20, 2021, Kansas City, Missouri, remote trial session. On September 15, 2021, the Court held a conference call with the parties. During the call, petitioner's counsel advised the Court that he is having difficulty obtaining documents from third parties and made an informal request for a continuance. The Court is willing to grant petitioner's counsel's informal request for a continuance, and the parties agree that the case should be added to the Court's November 15, 2021, Dallas, Texas, remote trial session for hearing on the status of the case at which time any third-party subpoenas may be returnable. Upon due consideration, it is hereby

ORDERED that this case is stricken from the September 20, 2021, Kansas City, Missouri, remote trial session. It is further

ORDERED that the case is scheduled for hearing on the status of the case at the Court's November 15, 2021, Dallas, Texas, remote trial session at a date and time certain of 2:00 p.m. Central Time (12:00 p.m. Pacific Time/3:00 p.m. Eastern Time) on Monday, November 15, 2021, at which any third-party subpoenas may be returnable. It is further

ORDERED that the Clerk of the Court shall serve on the parties a Notice of Remote Proceeding that shall contain comprehensive instructions on how to participate in the above-referenced remote proceeding. It is further

ORDERED that, no later than November 12, 2021, the parties shall file a joint status report advising the Court whether the third parties have complied with the subpoenas that are issued and a hearing is no longer necessary. It is further

ORDERED that, on or before November 1, 2021, the parties shall file a joint report with the Court (or, if that is not expedient, then separate reports) describing the status of the case. The report shall advise the Court of the parties' proposed schedule for trial preparation and trial in this case and the estimated time required for trial. It is further

ORDERED that, in addition to regular service of this Order, the Clerk of the Court shall serve on petitioner a copy of Form 14, Subpoena.
