ORDER


For the reasons and to the extent stated in the report and recommendation of Magistrate Judge Gorenstein, defendants' motion to dismiss is granted save with respect to the stop claim. The Court notes that, although it granted an extension of time within which to file objections, plaintiff has not objected to the RR.
