William F. Gallagher, Hugh D. Hughes and Thomas McNamara, New Haven, in support of the petition. Michael R. Bullers, assistant attorney general, in opposition.

The plaintiffs' petition for certification for appeal from the Appellate Court, 145 Conn.App. 75, 73 A.3d 886, is granted, limited to the following issues:

“1. Did the Appellate Court properly reverse the judgment of the trial court on the basis that the trial court incorrectly found that the state had assumed a greater duty of care than that reflected in industry custom or standards?

“2. Did the Appellate Court properly conclude that the state was not the proximate cause of the death of the plaintiffs' decedent?”

McDONALD, J., did not participate in the consideration of or decision on this petition.
