ORDER :
Plaintiff Curtis McDaniel, currently incarcerated at Rikers Island, is proceeding pro se and in forma pauperis. Plaintiff filed his original complaint on August 30, 2019. On September 12, 2019, Plaintiff filed another complaint bearing the docket number for this case, 19-CV-8166, and it was docketed as an amended complaint. (ECF 1:19-CV-8166, 3.) Plaintiff has now submitted a letter to the Court stating that he:
had to send duplicated amended report because my mail was being withheld. Case number 19-CV-8166 (CM) belongs in case 19-CV-3526 (CM). Please switch the amended report from case file 19-CV-8166 (CM) to case file 19-CV-3526. Also, I have not received confirmation that case 19-CV-7680 (UA) is acceptable or needs to be amended.(ECF Doc. 5.)
Plaintiff has four other pending cases in Court. In two of those cases, he has also written letters stating that documents have been filed in the wrong case. See McDaniel v. People, ECF 1:19-CV-3526, 21 (JPO) (S.D.N.Y. filed Apr. 19, 2019); McDaniel v. People, ECF 1:19-CV-7680, 10 (CM) (S.D.N.Y. filed Aug. 30, 2019). --------
The Clerk's Office docketed the amended complaint in this case because it bears docket number 19-CV-8166. Plaintiff cannot amend his amended pleading by submitting letters stating that certain documents within the amended pleading belong in a different case. At this point, the Court is unable to discern which documents correspond with each case. Accordingly, the Court grants Plaintiff leave to file a second amended complaint, labeled with docket number 19-CV-8166 (CM).
CONCLUSION
The Clerk of Court is directed to mail to Plaintiff a copy of this order and a "Second Amended Civil Rights Complaint" form, and note service on the docket.
Plaintiff is granted leave to file a second amended complaint. Plaintiff must submit the second amended complaint to this Court's Pro Se Intake Unit within sixty days of the date of this order, caption the document as an "Second Amended Complaint," and label the document with docket number 19-CV-8166 (CM). No summons will issue at this time. If Plaintiff fails to comply within the time allowed, and he cannot show good cause to excuse such failure, the Amended Complaint that he filed in this case on September 12, 2019, will be the operative pleading.
The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED. Dated: November 15, 2019
