McDade v. Wright

Appellate Division of the Supreme Court of New York, Second Department
Jan 31, 2000
268 A.D.2d 570 (N.Y. App. Div. 2000)

Opinion

Argued December 7, 1999

January 31, 2000

In an action to recover damages for medical malpractice, the plaintiff appeals from a judgment of the Supreme Court, Dutchess County (Bellantoni, J.), entered May 6, 1998, which, upon a jury verdict, dismissed the complaint.

Michael Kolb, Newburgh, N.Y., for appellant.

James A. Steinberg, Poughkeepsie, N.Y. (Ellen Fischer Bopp of counsel), for respondents.

DAVID S. RITTER, J.P., MYRIAM J. ALTMAN, ROBERT W. SCHMIDT, NANCY E. SMITH, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed, with costs.

Contrary to the plaintiff's contention, the computerized axial tomography scan films presented at trial were sufficiently authenticated by witnesses to allow them to be admitted as evidence (see, CPLR 4532-a).

The plaintiff's remaining contention is without merit.

RITTER, J.P., ALTMAN, SCHMIDT, and SMITH, JJ., concur.
