Appeal and Error — Reversal for Failure to File Answer Brief.
Section 1 of the syllabus in the case of Ellis v. Outler, 25 Okla. 469, 106 P. 957, is adopted as the syllabus in this case.
Appeal from District Court, Carter County; John B. Ogden, Judge.
Action by R.F. McCrory against Bert High. From a judgment for the defendant upon the verdict of a jury, plaintiff appeals. Reversed and remanded, with directions.

Upon authority of Ellis v. Outler, 25 Okla. 469, 106 P. 957, this cause is reversed and remanded for a new trial for failure of the defendant in error to file brief as required by rule 7 of this court.
