This case was originally calendared for trial at the Court's New York, New York Trial Session scheduled to commence on September 13, 2021. By Order dated August 4, 2021, jurisdiction of this case was retained by this Division of the Court.

On March 1, 2023, petitioner field with the Court a Motion for Leave to Seal Exhibit in Support of Memorandum Ordered by the Court on Feb 7, 2023, and concurrently therewith filed a Memorandum Pursuant to Court Order of Feb 7, 2023. Petitioner requests that the exhibit attached to the motion, pages from the administrative record for this claim and marked "CONFIDENTIAL - Section 6103 Information Subject to Protective Order.

Upon due consideration, and for cause, it is

ORDERED that petitioner's Motion for Leave to Seal Exhibit in Support of Memorandum Ordered by the Court on Feb 7, 2023, filed with the Court on March 1, 2023, is hereby retitled "Petitioner's Motion to Seal Exhibit in Support of Memorandum Ordered by the Court on Feb 7, 2023". It is further

ORDERED that Petitioner's Motion to Seal Exhibit in Support of Memorandum Ordered by the Court on Feb 7, 2023, is granted and the motion with attached exhibit at Docket Index No. 44 is placed under seal.
