ORDER

This whistleblower action, filed pursuant to Internal Revenue Code section 7623, is currently calendared on the Court's April 24, 2023, New York City, New York trial session. On March 1, 2023, petitioner filed a Motion to Compel Production of the Administrative Record (Doc. 16).

On March 3, 2023, respondent filed a Motion for Continuance (Doc. 17). Therein respondent advised the Court of his view that the Court lacks jurisdiction of this case and another case filed by petitioner at docket number 19730-22W. Respondent further advised the Court that all papers have been filed in docket number 19730-22W and the parties are awaiting the Court's opinion on the jurisdiction issue. Respondent also informed the Court of his view that the Court's opinion in docket number 19730-22W will conserve judicial resources in the instant case.

Upon due consideration, it is

ORDERED that petitioner's Motion to Compel Production of the Administrative Record is taken under advisement. It is further

ORDERED that, on or before April 10, 2023, the parties shall file a response to this Order (jointly if possible, otherwise separately) informing the Court of their position regarding a stipulation to be bound by the Court's opinion on the jurisdiction issue in the case at docket number 19730-22W.
