DARRIN L. MCCRAY Petitioner(s) v. STATE OF FLORIDA Respondent(s)

Lower Tribunal No(s).: 4D09-530; 502008CF007611FXXXMB

To the extent that petitioner seeks a writ of prohibition, the petition is hereby denied because petitioner has failed to demonstrate that a lower court is attempting to act in excess of its jurisdiction. See Mandico v. Taos Constr., Inc., 605 So. 2d 850 (Fla. 1992); English v. McCrary, 348 So. 2d 293 (Fla. 1977). To the extent tha petitioner seeks a writ of mandamus, because petitioner has failed to show a clear legal right to the relief requested, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000). All pending motions are hereby denied. No rehearing will be entertained by this Court. PARIENTE, LEWIS, CANADY, POLSTON, and PERRY, JJ., concur. A True Copy
