McCraith v. Carlino

Appellate Division of the Supreme Court of New York, Fourth Department
Sep 1, 1923
206 App. Div. 812 (N.Y. App. Div. 1923)

Opinion

September, 1923.

Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, on the ground that in view of the age and physical condition of the plaintiff, and the fact that, owing to the congested condition of the calendar on Erie county, a speedy trial of this action cannot be had in that county, the ends of justice require that the place of trial be retained in Niagara county, where the venue was originally laid. All concur.
