Court of Appeals of Texas, Fifth District, Dallas
Jul 1, 2009
No. 05-08-01517-CV (Tex. App. Jul. 1, 2009)

Opinion

No. 05-08-01517-CV

Opinion Filed July 1, 2009.

On Appeal from the 162nd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 07-04385.

Before Justices MOSELEY, O'NEILL, and MURPHY.

MEMORANDUM OPINION

Appellant's brief was originally due February 25, 2009. This Court has granted appellant numerous extensions of time to file his brief, but has denied appellant's motions to be provided a personal copy of the record filed with this Court. Appellant was warned that if he failed to file his brief, we would dismiss the appeal. See Tex. R. App. P. 38.8(a), 42.3(c). Rather than filing his brief in accordance with this Court's orders, on June 19, 2009, appellant again filed a motion to compel the trial court to provide him with a personal copy of the record. We deny the motion. We dismiss the appeal for want of prosecution.

Appellant filed its as a pro se petition for writ of mandamus. We, however, are treating the document as a motion in the appeal.
