McCormick v. Podol

Supreme Court of Florida, Division B
Dec 17, 1948
37 So. 2d 911 (Fla. 1948)

Opinion

December 17, 1948.

Appeal from Circuit Court, Palm Beach County; Jos. S. White, Judge.

Newman T. Miller, of West Palm Beach, and Morehead, Pallot, Smith, Green Phillips, of Miami, for appellant.

Phil D. O'Connell and James Nemec, both of West Palm Beach, for appellee.

We are of the opinion that the verdict of $10,000 for the injuries sustained is excessive and the ends of justice require a new trial only on the question of damages.

The judgment is reversed and a new trial granted.

Reversed.

THOMAS, C.J., and ADAMS, BARNS, and HOBSON, JJ., concur.
