Appeal and Error — Reversal Where no Answer Brief Filed.

Where defendant in error fails to file brief this court may exercise its discretion under rule 7 of the rules of this court and reverse the cause without an examination of the record.

Error from District Court, Murray County; W.G. Long, Judge.

Action by Etta Lukins against L.E. McCormick, Judgment for plaintiff, and defendant appeals. Reversed and remanded.

Upon authority of Ellis v. Outler, 25 Okla. 469, 108 P. 957, this cause is reversed and remanded for failure of the defendant in error to file brief as required by rule 7 of this court.
