By Notice dated October 7, 2021, this case is calendared for trial on the Court's February 22, 2022, New York, New York trial calendar. On October 29, 2021, the Court held a conference call with petitioner Barry McCombs and respondent's counsel. Respondent and petitioner agreed to a basis of settlement of this matter. The Court advised the parties that they should continue to communicate to procure a signed settlement document to be submitted to the Court.

Premises considered, it is

ORDERED that the parties shall, on or before November 30, 2021, either submit settlement documents or file status report(s) (joint or separate) advising the Court as to the then present status of this case.
