This case is calendared for trial at the Trial Session of the Court scheduled to commence on February 13, 2023, in Philadelphia, Pennsylvania.
On January 18, 2023, the parties filed with the Court a Proposed Stipulated Decision (Index No. 11). Upon the Court's review, it appeared that the amount of the deficiency shown as owed by petitioner was not in accordance with the notice of deficiency or settlement stipulation. On February 6, 2023, the parties filed with the Court a corrected Proposed Stipulated Decision (Index No. 13).
Upon due consideration, and for cause, it is
ORDERED that the parties' Proposed Stipulated Decision at Index No. 11, filed with the Court on January 18, 2023, is hereby stricken from the record of this case.
