Court of Appeals of Texas, First District, Houston

No. 01-08-00414-CV (Tex. App. Sep. 16, 2009)

Opinion

No. 01-08-00414-CV

Order issued September 16, 2009.

On Appeal from the 165th District Court, Harris County, Texas, Trial Court Cause No. 2006-50301.

Panel consists of Justices KEYES, HANKS and BLAND.

ORDER ON MOTION FOR REHEARING

On May 21, 2009, this Court dismissed this appeal for want of jurisdiction, finding that appellant, Carolyn K. McCollum, did not timely file her notice of appeal or timely file a motion for new trial, and that this court therefore lacked jurisdiction to consider the merits of her appeal. On rehearing, McCollum has filed an unopposed request to supplement the clerk's record with a copy of her motion for new trial filed stamped five days earlier than the date of the copy currently contained in the clerk's record.

We GRANT appellant's motion for rehearing and motion to supplement the record and withdraw our opinion and judgment of May 21, 2009. The case will be resubmitted on a date in the future yet to be determined, and the parties will be notified of the new submission date.

It is so ORDERED.
