ORDER


AND NOW, TO WIT, this 12th day of January 2009, upon consideration of Plaintiff's request that a nurse employed by Plaintiff attend and tape record the defense medical examination ("DME") of Plaintiff and the Defendants opposition thereto, IT IS HEREBY ORDERED that Plaintiff's request be DENIED in part. The Parties do not contest the need for the DME. The Court finds that the DME will not be recorded and that a health care professional may not be present during the examination. A health care professional may accompany Plaintiff to the examiner's office and Plaintiff may consult with the health care professional concerning health issues at any point during the examination. The Court reserves the right to supplement this Order.
