By order of February 27, 1998, the application for leave to appeal the April 11, 1997 decision of the Court of Appeals was held in abeyance pending the decisions in McDougall v Eliuk (Docket No. 107956), Cicola vRosenthal (Docket No. 108775), and Sobran v McKendrick (Docket No. 110707).

On order of the Court, the decision in McDougall v Schanz and Sobran v McKendrick having been issued on July 30, 1999, 461 Mich. ___ (1999), the application is again considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for reconsideration in light of McDougall and Sobran.

We do not retain jurisdiction.
