RENATHA LOVETTE MCCAULEY & LEM E. MCCAULEY, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Adam B. Landy, Special Trial Judge.

This case is calendared for trial at the October 11, 2022, Atlanta, Georgia, Trial Session of the Court.

On July 20, 2022, respondent filed a response to the Court's Order dated June 13, 2022, noting the difficulty he had in contacting petitioners to possibly resolve this case. In response, the undersigned's Chambers Administrator contacted petitioners, by telephone and electronic mail, to initiate a telephone conference to discuss this case and respondent's report with the parties. Petitioners advised the Court that they no longer wished to pursue this case on the merits. Based on petitioners' other comments, the Court infers that petitioners do not intend to submit a status report to the Court or further participate in their case.

Upon due consideration of respondent's response and for cause, it is

ORDERED that, on or before August 5, 2022, respondent shall file an appropriate motion, or in the alternative, the parties shall file a status report (preferably a joint report) to inform the Court of the then-present status of this case.
