MEMORANDUM AND ORDER


Defendant has filed a motion for summary judgment, to which plaintiff has not responded. It appears from the motion and the exhibits attached that the plaintiff's payments had been properly credited.

According to the uncontradicted declaration of Daria Gallen, appeals collection officer, all proper procedures were followed in the collection due process.

AND NOW, this 20th day of August, 2004, it is hereby ORDERED that defendant's motion for summary judgment (Docket Nos. 5 and 6, duplicate filing) is GRANTED, and plaintiff's Complaint is DISMISSED with prejudice.

This case is CLOSED.
