This matter having come before the Court on the motion of Defendant, the United States of America, for summary judgment Counts I, II, and IV of Plaintiffs' Complaint; and Plaintiffs L. Thorne McCarty and Mary Lynne Robertson's cross-motion for summary judgment as to Count IV of the Complaint; and this Court having considered the submissions of the parties and rendered an Opinion without oral argument pursuant to Fed.R.Civ.P. 78;

IT IS on this 29th Day of January, 2004, for the reasons set forth in this Court's Opinion accompnaying this Order and dated the same, ORDERED that Defendant's motion for summary judgment is hereby GRANTED and Plaintiffs' cross-motion for summary judgment is DENIED.
