    Suit by Eva McCaleb against the Continental Casualty Company, as the insurance carrier for the City of Corpus Christi, as the widow and beneficiary of Joseph McCaleb who was killed while in line of his employment with said city. The trial court sustained a plea in abatement filed by the defendant insurance company, and that judgment was affirmed by the Court of Civil Appeals ( 113 S.W.2d 347), and the plaintiff has brought error to the Supreme Court. Judgments of both courts reversed and the cause is remanded to the trial court for another trial.
