Gregory Patrick MCBRIDE, Appellant v. The STATE of Texas, Appellee

From the 175th Judicial District Court, Bexar County, Texas
Trial Court No. 2014CR2401
Honorable Raymond Angelini, Judge Presiding

ORDER

By order dated March 24, 2016, we abated this appeal to the trial court for the entry of findings of fact and conclusions of law. On April 1, 2016, a supplemental reporter's record was filed containing verbal findings of fact and conclusions of law. On April 15, 2016, a supplemental clerk's record was filed containing the trial court's order stating the findings of fact and conclusions of law contained in the supplemental reporter's record filed on April 1, 2016, were not the findings and conclusions germane to the underlying cause. On April 19, 2016, a supplemental reporter's record was filed containing the findings and conclusions germane to the underlying cause. The trial court stated it would be relying on the findings and conclusions verbally stated in the supplemental reporter's record and would not be submitting verbal findings and conclusions.

It is therefore ORDERED that this appeal is REINSTATED on the docket of this court. As noted in our prior order, the parties will be permitted to file amended or supplemental briefs.

If the appellant intends to file an amended or supplemental brief, such amended or supplemental brief must be filed no later than thirty days from the date of this order. The State's amended or supplemental brief will be due thirty days after the appellant files his amended or supplemental brief.

If a party does not intend to file an amended or supplemental brief, the party must file written notice of such intent no later than ten days from the date of this order.

Sandee Bryan Marion, Chief Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 20th day of April, 2016.
