In an action to compel conveyance of title to real property, plaintiff appeals: (1) from an order of the Supreme Court, Queens County, dated March 13, 1961, confirming the report of the Official Referee, granting the motion of defendant Rose Mary McAndrews to enter judgment in accordance with a stipulation of the parties previously made in open court upon the trial before the Referee, and denying plaintiff's cross motion to disaffirm the Official Referee's report, to vacate all proceedings had before the Referee, including the stipulation, and to refer the case back to the Special Term Trial Calendar; and (2) from the judgment of said court, entered March 24, 1961 upon said order, effectuating the terms of such stipulation. Order affirmed, with $10 costs and disbursements. Judgment affirmed, with costs. No opinion. Beldock, Acting P.J., Ughetta, Kleinfeld, Pette and Brennan, JJ., concur.
