Opinion
Argued October 29th, 1936.
Decided January 28th, 1937.
Decree affirmed, solely because the court of errors and appeals is equally divided on the question in issue.
On appeal from a decree of the court of chancery advised by Vice-Chancellor Sooy, whose opinion is reported at 120 N.J. Eq. 407.
The judges being equally divided on the question whether the decree should be reversed, the decree is affirmed solely because of such division, which renders any opinion by the court impossible.
Messrs. McCarter English, for the appellants.
Messrs. Cole Cole, Messrs. Babcock Champion and Mr. Merritt Lane, for the respondents.
The decree under review is affirmed, by an equally divided court.
For affirmance — TRENCHARD, LLOYD, CASE, PERSKIE, HETFIELD, DEAR, WELLS, JJ. 7.
For reversal — THE CHIEF-JUSTICE, PARKER, BODINE, HEHER, WOLFSKEIL, RAFFERTY, COLE, JJ. 7.
