Joseph Arthur Mbacho & Brenda Mbacho Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Patrick J. Urda Judge.

This collection due process (CDP) case was stricken from the Court's September 20, 2021, San Diego, California, remote trial session, and jurisdiction was retained by the undersigned.

On June 3, 2021, the Court granted the motion to remand and this case was remanded to the Independent Office of Appeals for a supplemental hearing. On October 29, 2021, the Commissioner filed a status report, which indicated that the Settlement Officer issued a supplemental notice of determination only to petitioner Joseph Arthur Mbacho and that he intends to file a motion to dismiss for lack of jurisdiction as to petitioner Brenda Mbacho. The Commissioner requests that the Court maintain this case on a status report track to allow the parties to execute a decision document. We will grant the relief. Accordingly, it is

ORDERED that, on or before December 6, 2021, the Commissioner shall file an appropriate motion as to Ms. Mbacho. It is further

ORDERED that, on or before January 3, 2022, the parties shall file a joint status report (or separate reports, if that is more expedient) as to the then-present status of this case.
