MEMORANDUM OPINION


A review of this appeal shows Deloris Maynard filed her April 11, 2005 notice of appeal. Ms. Maynard did not file an affidavit of indigency.

In a letter dated June 28, 2005, the Court instructed Ms. Maynard to pay the $125 filing fee within ten days of the date of the letter or risk dismissal of her appeal. In a letter dated August 3, 2005, we sent Ms. Maynard a second letter advising her that the $125 filing fee was overdue and instructing her to pay the fee by August 13, 2005. We cautioned Ms. Maynard that the failure to do so would result in dismissal of this appeal without further notice. To date, Ms. Maynard has not responded.

Accordingly, we DISMISS this appeal for want of prosecution. See Appendix to the Tex.R.App.P. B(1)(a); Tex.R.App.P. 5 and 42.3.
