On February 1, 2024, we issued an order retaining jurisdiction over these appeals. In accordance with our order, the clerk of this court retained appellants' claims against appellees William R. Lucero and Jacob Vos in Cause Number 04-23-00665-CV; assigned appellants' claims against appellee Jacob Zimmerman to Cause Number 04-24-0073-CV; and assigned appellants' claims against appellee Mark Bankston to Cause Number 04-24-00074-CV.
No reporter's record has been filed in any of the three appeals, and our records do not show that appellants have filed docketing statements or other documents identifying any court reporters who recorded records in the trial court. Additionally, on February 13, 2024, appellants filed a motion in Cause Number 04-24-00073-CV representing that the clerk's record is not complete.
If any portions of the clerk's or reporter's records have yet to be filed in this case, we ORDER appellants to file written notice in this court by March 1, 2024 that:
(1) identifies the missing records; and
(2) includes written proof that appellants have requested and either paid or made arrangements to pay for the preparation of the missing records in accordance with Texas Rules of Appellate Procedure 34.5(b) and 34.6(b).
Appellants' written notices must be filed separately in Cause Numbers 04-23-00665-CV, 04-24-0073-CV, and 04-24-00074-CV. If appellants file the written notices required by this order, the applicable clerk's and/or reporter's records will be due by April 1, 2024, and appellants' briefs will be due 30 days after the records are filed.
If appellants do not file the written notices required by this order, we will assume the appellate record is complete, and appellants' briefs will be due by April 1, 2024. If appellants do not take the necessary steps to cause a reporter's record to be filed, the court will consider only those issues or points raised in appellants' briefs that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
