On November 4, 2022, the Commissioner filed a motion to compel the production of documents and a motion to compel responses to interrogatories. Those motions describe a failure by Mr. Mayhew's counsel to respond to communications from the Commissioner's counsel. They also indicate a failure by Mr. Mayhew's counsel to update his contact information with either Counsel for the Commissioner or the Court. It is unknown whether Mr. Mayhew is personally aware of the difficulties the Commissioner is having communicating with his counsel.
We note that the standing pre-trial order in this case requires proposed trial exhibits to be exchanged by the parties no later than December 5, 2022. We caution that the failure to provide timely responses to discovery may result in the Court excluding the information that should have been provided from evidence at trial. Accordingly, it is
ORDERED that the Commissioner's Motion to Compel Production of Documents, filed November 4, 2022, is granted. Petitioner shall complete his response by December 5, 2022. It is further
ORDERED that the Commissioner's Motion to Compel Responses to Interrogatories, filed November 4, 2022, is granted. Petitioner shall complete his response by December 5, 2022. It is further
ORDERED that Mr. Muinos, petitioner's counsel, shall update his contact information with the Court by November 23, 2022. (This may be done electronically through DAWSON.) It is further
ORDERED that, in addition to regular service, the Clerk of the Court shall mail a copy of this order to Mr. Mayhew at the address appearing paragraph 1 of the petition in this case.
