Order unanimously modified by denying the motion to strike out the denial of that part of paragraph "Fifth" of the amended complaint beginning with the words "and as a result of said collision" and continuing to the end of said paragraph; and as so modified affirmed, without costs, with leave to the defendant to serve a further amended answer within five days after service of order with notice of entry thereof. No opinion.
