On order of the Court, the delayed application for leave to appeal from the April 27, 2001 decision of the Court of Appeals and the motion for leave to file brief amicus curiae are considered. The motion for leave to file brief amicus curiae is GRANTED. The delayed application for leave to appeal is DENIED, because we are not persuaded that the question presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would grant leave to appeal.
