Maurici-Lino v. Brooks

District Court of Appeal of Florida, Second District
Dec 22, 1971
255 So. 2d 546 (Fla. Dist. Ct. App. 1971)

Opinion

No. 71-82.

December 22, 1971.

Appeal from Circuit Court, Hillsborough County; Jas. D. Bruton, Jr., Judge.

Boyt L. Elam, of Barrs, Melendi Williamson, Tampa, for appellant.

Benjamin H. Hill, III, of Shackleford, Farrior, Stallings Evans, P.A., Tampa, for appellees.

Appellant, plaintiff below, takes this appeal from a final summary judgment entered in favor of appellees.

Upon careful examination of the record on appeal it appears that there are genuine issues of material facts which preclude the entry of a summary judgment.

Reversed and remanded.

PIERCE, C.J., and LILES and HOBSON, JJ., concur.
