Oscar R. Matute Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Christian N. Weiler Judge

This case is calendared for trial on the Court's December 13, 2021, Jacksonville, Florida remote trial session. On October 19, 2021, the parties filed a joint motion for continuance asking the Court to restore this case to the general docket. The motion states that petitioner's case was just recently transferred to IRS Appeals for consideration. Respondent's counsel has been informed that petitioner is in the process of gathering documentation requested by IRS Appeals, and anticipates providing the Appeals Officer assigned to petitioner's case with the aforementioned documentation. The parties need more time to allow petitioner and IRS Appeals time to work through petitioner's case without upcoming trial deadlines impeding their ability to thoroughly consider all of the issues present, and potentially settle petitioner's case without need of trial.

Upon due consideration, it is

ORDERED that the parties' joint motion for continuance is granted and this case is stricken from the December 13, 2021, Jacksonville, Florida remote trial session and is continued generally.
